What is Khatian
khatian means landlord’s name and tenant’s name, land mark number, quantity, nature, rent rate, etc., along with details of one or more landowners’ land-arisen land records that are prepare during the land survey, is Khatian.
The government of each country conducts surveys every 20-30 years to update the land information of its citizens. Some errors are made in the register during the act of the survey. For that, the survey staff prepares a draft ledger regarding the land after completing the survey work. Prior to the final publication of the ledger, a draft ledger is provide to the original owner of the property at the time announce by the government, so that the landowner can see if there is any misrepresentation in the draft regarding his property.
Apply for mistakes of Khatian
There is an opportunity to amend the draft ledger by applying to the concern Assistant Commissioner Land Office for correcting the errors in the ledger within the time specified by the government. In that case, if the error in the draft is reasonable, then the Assistant Commissioner of Land will correct your ledger. If he is not glad with the mistake and the ledger of your ownership is erroneously disclose, that is, any wrongdoing of your property remains in the final ledger, you must be inform within one year after the ledger is finally disclose or within one year after the land survey tribunal is formed in your district. You will have to file a suit in the tribunal under section 145A (4) of the State Acquisition and Tenancy Act 1950 to correct the errors in your account.
Court procedure
According to the law, if you can satisfy the court with special consideration in this case, you can get a maximum of one more year to file a case. A lawsuit can file in the said tribunal to modify the latest ledger prepare by the government. If any mistake is found in previous register, you look for expiation by going to the court of jurisdiction for seeking a declaration to rectify the errors in the register.
Appeal
If the court is not satisfy for the amendment of your records even after bringing the case to the tribunal. if the case is dismiss you are aggrieve by the judgment of the said tribunal, you can file a leave to appeal in the appellate division of the Honorable Supreme Court. Can get the desire remedy.
