Profs. Jasmine Harris and Karen Tani L’07, PhD’11 along with Shira Wakschlag, Senior Director of Legal Advocacy & General Counsel of The Arc of the United States, have co-authored a pathbreaking paper that highlights the disability through-line in the Supreme Court’s recent cases.

In writing the article, Harris, Tani, and Wakschlag aim to help the American public understand the significance of disability-related cases to important debates about inclusion and resource distribution, as well as to show how non-disability cases may disproportionally impact people with disabilities.

Here, Harris and Tani discuss their paper, addressing the following questions:

What does it mean to look at SCOTUS decisions through a disability lens?

Can you discuss Talevski, viewed through a disability lens?

What are some “strategic litigation” strategies in disability law?

Which areas of law could most benefit from examination through a disability lens?

Are there any current SCOTUS cases you’re watching?
