Muda Scam: Kapil Sibal reacts to Karnataka HC’s verdict on Siddaramaiah

Rajya Sabha MP Kapil Sibal on September 25 expressed disappointment over Karnataka HC dismissing CM Siddaramaiah's petition challenging the Governor's sanction for his prosecution in an alleged MUDA scam. He claimed that Governor has no constitutional right to become a judge and decide whether a criminal offence has occurred or not. He further prompted that first investigation should be conducted and then the sanctions should be granted.
Addressing the press, Rajya Sabha MP Kapil Sibal said, "It is nowhere written in the Constitution that Governor can give sanctions for prosecution...The Supreme Court has said that if there is any case against the CM, the Governor is the competent authority to grant sanction...It is the courts that decide whether there has been any violation or not. How can the Governor decide without any magisterial enquiry that the allegations against the accused are true?... The Governor has no constitutional right to become a judge and decide whether a criminal offence has occurred or not...First investigation should be conducted then the sanctions should be granted..."
