Commander K. M. Nanavati vs. State of Maharashtra was a 1959 Indian court case where Kawas Manekshaw Nanavati, a Naval Commander, was tried for the murder of Prem Ahuja, his wife's lover. The case received unprecedented media coverage. It is also known to be the last case to be heard as a jury trial in India since the Government abolished the jury system as a result of this case.
The supreme court held that power under Article 161 and Article 136 are both separate and unfettered. One is executive power and one is judicial power, there is no mention in the constitution that one prevails over the other. Both the Articles should be read harmoniously. When the matter is in consideration under SLP it is discretion of SC whether relief given under Article 136 should continue or not.
