For your information, the case of UNITRACTIONAL Termination of Employment [PHK] experienced by worker [Leo] began with a work strike carried out by Leo and around 20 of his friends on February 16 2023, which according to the company was an illegal work strike. Even though Permenaker No. 232 of 2003 clearly regulates sanctions for strikes, including strikes which are categorized as illegal strikes - There are no sanctions for layoffs!

The action was based on the company not providing the proper space for dialogue with employees. The result of this action resulted in the layoff of Leo, who was known from the start and reminded that the company's actions towards Leo were unreasonable and violated labor regulations.

Efforts to subpoena the company, then filing Bipartite, Tripartite at the Ministry of Manpower of the Republic of Indonesia until a lawsuit against PHI at the Serang District Court was carried out to obtain justice, until finally Leo appealed to the Supreme Court with the panel's decision that Leo was still dismissed unilaterally even though WITHOUT ANY MISTAKE because the panel thought he had There was a disharmonious relationship between Leo and the company, and his layoff was categorized as EFFICIENCY - The cassation decision also stated that the Suspension Letter & Layoff Letter issued by the company to Leo was invalid & null and void.
